Terms and Conditions of 'Try Dry: The Dry January app'

Please carefully read the following terms and conditions relating to use of ‘Try Dry®. Dry January® and beyond’. By clicking 'I Accept' during app sign-up you agree to be bound by these Terms and Conditions of use. If you do not agree to be bound by these Terms and Conditions, you should uninstall the application.

1. About ‘Try Dry®. Dry January® and beyond’

a) ‘Try Dry®. Dry January® and beyond’ is the official mobile application of Dry January.

b) Dry January is a campaign of Alcohol Change UK.

c) All trademarks that appear in ‘Try Dry®. Dry January® and beyond’ are trademarks owned by Alcohol Change UK.

d) Alcohol Change UK is the operating name of Alcohol Research UK registered as a Charity No. 1140287, and Company Limited by Guarantee in England and Wales No. 7462605.

2. ‘Try Dry®. Dry January® and beyond’ Content:

a) To access the content of ‘Try Dry®. Dry January® and beyond’ you must be a registered, non-expired member with a valid registered email and password.

b) We reserve the right to modify, alter, or discontinue any aspect of the mobile application at our discretion and without prior notice or liability.

c) ‘Try Dry®. Dry January® and beyond’ contains information, software, photos, text, graphics, sounds and other materials that are protected by copyrights, trademarks, trade secrets and/or other proprietary rights.

d) All content is copyrighted under applicable copyright laws, including the United States, United Kingdom, and European Union copyright laws (and, if applicable, similar laws in other jurisdictions).

e) You may not modify, publish, transmit, distribute, perform, participate in the transfer of or sell, create derivative works of, or in any way exploit, any of the content, in whole or in part unless you receive our prior written consent.

f) Alcohol Change UK reserves the right to vary service content by phone model and country, including but not limited to (i) size and extent of the drinks database, (ii) the app functionality and (iii) introduce premium subscription options and pricing.

b) The privacy notice describes how and why Alcohol Change UK uses your personal information, how we protect your privacy when doing so, and your rights and choices regarding this information.

4. Health Disclaimers:

a) ‘Try Dry®. Dry January® and beyond’ is intended as a tool to assist users give up alcohol for the month of January and to track their drinking all year around. Alcohol Change UK is not a medical organisation and we cannot give you medical advice or diagnosis.

b) Any information contained within the ‘Try Dry®. Dry January® and beyond’ should not be construed as advice or diagnosis. The mobile application is only intended for use by healthy adults and not by anyone under the age of 18.

c) ‘Try Dry®. Dry January® and beyond’ and the Dry January campaign are not suitable for dependent drinkers and is not a medical detoxification programme. If you think you may have dependency issues, contact a doctor immediately.

d) ‘Try Dry®. Dry January® and beyond’ and the Dry January campaign isn’t right for everyone. If you drink very heavily or regularly you should check with your doctor before stopping drinking for Dry January. If you experience any physical symptoms when you stop drinking you should absolutely not do a dry month and should seek medical help urgently.

e) It is the responsibility of all users of the ‘Try Dry®. Dry January® and beyond’ to satisfy themselves as to their personal medical and physical condition in determining whether or not to use or adapt the information or content provided.

f) Reliance on any information appearing on ‘Try Dry®. Dry January® and beyond’ or its links to the Alcohol Change UK Web Site, whether provided by Alcohol Change UK, its content providers, visitors to the Web Site or others, is solely at your own risk.

g) Notwithstanding the medical or physical condition of a user, no responsibility or liability is accepted for any loss or damage suffered, or illnesses, diseases and medical conditions developed by an individual as a result of the use or misuse of any of the information or content in ‘Try Dry®. Dry January® and beyond’.

5. Disclaimers of Warranties

a) Any product, offering, content and material downloaded or otherwise obtained through the use of ‘Try Dry®. Dry January® and beyond’ is done at your sole risk and you will be solely responsible for any damage to your mobile phone or loss of data that results from the download of any such product, offering, content or material.

b) You agree to indemnify and hold Alcohol Change UK, its parent company, subsidiaries, affiliates, officers, agents, directors, contractors, licensors and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of or in connection with (i) your use of the Service, and (ii) the breach by you of your representations and warranties set forth herein.

c) Whilst every endeavour is made to ensure the optimal functioning of the app. Alcohol Change UK does not guarantee that ‘Try Dry®. Dry January® and beyond’ will be error free and uninterrupted or that defects will be corrected.

d) Whilst every endeavour is made to ensure the accuracy of the data, Alcohol Change UK will not be held accountable for any errors in content, or outcomes resulting from the errors.

6. Limitation of Liability

a) You understand and agree (to the fullest extent permitted by law) Alcohol Change UK and related third parties will not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or any other damages whatsoever, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of, or resulting from:

i) the use or the inability to use ‘Try Dry®. Dry January® and beyond’.

ii) the use of any content or other materials in ‘Try Dry®. Dry January® and beyond’.

iii) the cost of buying substitute goods and services resulting from any goods, data, information or services purchased or obtained through messages received, or transactions entered into, from using ‘Try Dry®. Dry January® and beyond’.

b) If you are dissatisfied with any portion of ‘Try Dry®. Dry January® and beyond’, or with any of the provisions of these Terms & Conditions, your sole and exclusive remedy is to cease using the app and to uninstall the software.

7. Supplementary Charges

a) It is the sole responsibility of the user to check with their network provider about data charges that may arise through: the initial download installation or subsequent use of features through Mobile Internet connection. Data transfer charges depend upon the service agreement you have with your network provider. We advise you to check what charges might apply before commencing download and use of ‘Try Dry®. Dry January® and beyond’.

b) Alcohol Change UK cannot be held liable for, and will not pay for or refund any data charges that you may incur through use of this App.

8. Price and payment Information

a) ‘Try Dry®. Dry January® and beyond’ is available for free download in the Google Play Store and Apple App Store.
